Ad Valorem Homestead Tax Exemption

Beginning January 1, 2007, HB 81 became Georgia law to benefit the surviving spouses of law enforcement officers and firefighters killed in the line of duty. Under this law, the un-remarried surviving spouse of a peace officer or firefighter killed in the line of duty became exempt from paying ad valorem taxes for the full value of their homestead. An affidavit is provided by the tax commissioner of the county in which they live and must be filed to determine their eligibility for exemption. Annual renewal is automatic as long as the surviving spouse does not remarry. It is the duty of the surviving spouse to notify the tax commissioner’s office if they should become ineligible in the future by re-marrying.
